TERMS AND CONDITIONS
RESPONSIBILITIES AND RIGHTS OF THE PARTIES
1.0 This booking form confirms an order for the services of Greg Michael Film for videography/media related services, as agreed by both Greg Michael Film and the Hiring Party. Unless otherwise agreed Greg Michael Film reserves the rights to use all footage and/or reproductions for advertising, display, publication and other purposes.
1.1 In the event that Greg Michael Film is unable to perform the agreed booking in whole or in part due to circumstances beyond the control of the parties, including but not limited to Acts of God, terrorism, war, or the outbreak of fire, or due to the videographer’s illness or injury, the Hiring Party is freed from its obligation to pay Greg Michael Film any outstanding fees, with the exception of kit hire and other fees already incurred by Greg Michael Film at the date of frustration. In the event of such circumstances, the Hiring Party also agrees that Greg Michael Film will incur no further liability with respect to this agreement.
1.2 Greg Michael Film will not be liable for any footage damaged or lost as a result of equipment malfunction, footage lost in the post, or otherwise lost or damaged without fault of the videographer. Subject to the sole discretion of the videographers, the parties may arrange for the replication, reenactment or repetition of the event, in order to recapture the material lost.
1.3 The parties understand that Greg Michael Film are independent contractors with respect to the Hiring Party and is not an employee of the latter. The Hiring Party will not provide benefits including health insurance, paid vacation, or any employment benefit for the benefit of the videographers.
1.4 Greg Michael Film’s services are outlined in these terms and conditions and any verbal agreement is null and void. Any additions to this contract must be done so in writing and approved by both parties in the agreement.
PAYMENT FOR SERVICES
2.0 The charges for videography work are based on the videographers’ standard price list. The price list is adjusted periodically and future orders will be charged at the prices in effect at the time when an order is placed.
2.1 The Hiring Party agrees to pay 100% of the cost of any rented kit that that has been hired for a shoot, regardless of the completion of the shoot.
2.2 All late payments are subject to a charge of 8% per day that they are late. This is 8% of the remaining unpaid fee that is owed for the contracted work.
2.3 For changes to, or cancellation of bookings:
- Cancellations are based on the package that is booked.
- Once a shoot is confirmed, cancellations of less than 24 hours will be charged in full.
- Cancellations between 1 to 3 days before will be charged at 75%.
- Cancellations 4 days or more before will be charged at 65%.
- Cancellations with a notice period of 21 days or more will not be charged.
In the event that a change or cancellation is made, 100% of all fees and expenses are due and payable to Greg Michael Film without the requirement that any further duties be fulfilled by Greg Michael.
2.4 Any change or cancellation made within twenty one days of the work date/s specified in this contract constitutes a violation of said contract, as a consequence of which all fees and expenses are due and payable to Greg Michael Film immediately, as though the contract had been completed, and without the requirement that any further duties be fulfilled by Greg Michael Film.
2.5 Any rescheduled date/s will require a new booking form.
2.6 Performance is dependant upon the rules and limitations set by the event organisers and/or location hosts. It is the obligation of the Hiring Party to obtain all relevant filming permissions and access on behalf of Greg Michael Film prior to a shoot. Failure to do so will result in the inability to film certain shots and will affect the quality of the video. If no permissions are organised by the client and the videographers are unable to film as a result then the videographers may leave without further duties being fulfilled and no refund will be issued.
2.7 If shoots are delayed and overrun, even if not the fault of the Hiring Party, overtime rates shall be incurred by the Hiring Party. Shoot rates are based on ten-hour days and overtime is charged at £52.50 per hour. Edit rates are based on normal office working hours (9.00 – 17.00, or 10.00 – 18.00), and overtime is charged at £52.50 per hour. Performance by Greg Michael Film which does not amount to a full-day’s work, will nevertheless be charged at a full-day’s rate.
2.8 Location Recce’s are advised by Greg Michael Film. If a client does not wish to budget for a recce, Greg Michael Film is not liable for any inhibiting effect upon the delivery of the final product, caused by factors determined by the location itself, including, but not limited to, poor lighting and audio interruptions.
2.9 For bookings longer than five consecutive days, a deposit of 50% of the overall costs of the production is due 30 days from the date that this contract is signed and must be paid in advanced of a scheduled shoot date in order to confirm a booking with Greg Michael Film.
COURTIOUS VIDEOGRAPHY GUIDELINES
3.0 In order to deliver professional videos that you have paid good money for, Greg Michael Film implements the following rules. Greg Michael is not liable for unsatisfactory content if these rules are breached. It is the Hiring Party’s responsibility to inform all guests at a shoot of these rules.
- It is the obligation of the Hiring Party to obtain all relevant filming permissions and access on behalf of Greg Michael Film, prior to a shoot. Failure to do so will result in the inability to film certain shots and will affect the quality of the video.
- Locations for interviews should be interior and in a location that noise and light can be controlled.
- Interviewees should avoid wearing branded or patterned clothing.
- Greg Michael Film moves a lot and cannot worry about getting in the way of guests’ cameras. Greg Michael Film aims to be unobtrusive but there are certain camera angles that may necessitate a more obvious presence.
- Keep all children away from Greg Michael Film’s equipment. If a tripod is knocked over and expensive kit is damaged or broken, the Hiring Party is liable, unless the damage was directly and solely caused by Greg Michael Film.
- Please ensure that all guests and attendees at a shoot are made aware of the above rules.
3.1 If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
